YoungJoo Song is a trademark attorney and partner at Yoon & Yang (IP) LLC. Before becoming an attorney, Ms Song was a simultaneous English interpreter and in-house interpreter in various industries, which helped her to perfect her communication skills. Her fluency in English and Chinese help her to provide her clients with clear, practical advice.
Ms Song’s work focuses on trademark and design in both prosecution and enforcement. She manages the international trademark portfolios of several Korean clients, drawing on her wealth of knowledge of the trademark practices of different countries as well as the Madrid System. She has designed and implemented trademark protection strategies for foreign brands facing counterfeit or genericisation issues in Korea, executing such enforcement activities as customs actions, warning letters, retail raids and criminal complaints. Ms Song has had significant success in handling matters before the Korean Intellectual Property Office and courts. Her most recent success was when the Korean Supreme Court recognised the universal fame of the MCM mark in 2020. Marks recognised as universally famous are granted a broader scope of protection that includes both similar and dissimilar marks.
A frequent speaker at international conferences, Ms Song spoke about the plain packaging for tobacco products at the AIPPI Annual Meeting in 2012, explained how the similarity of marks is determined in Korea at the PTMG Autumn Meeting in 2016, introduced recent changes in Korean trademark law at the INTA Annual Meeting in 2017 and discussed the interrelation of domain names, application names and trademarks at the IDRC·ADNDRC International Conference in 2017.
Ms Song’s work extends beyond trademark issues. At AIPPI Trilateral (China, Japan and Korea) Meetings in 2018 and 2019, she explained the partial design system in Korea and offered her insights on consumer survey evidence in trademark disputes. The Korean Patent Attorneys Association recognised Ms Song’s active involvement in international cooperation events and activities organised by KIPO and other Korean IP organisations and gave her an achievement award in 2012.
