An experienced trademark practitioner and partner, Tracy Arch manages one of Barker Brettell’s largest teams of trademark attorneys. Ms Arch oversees the trademark portfolios of several large national and multinational clients, using a wealth of experience to advise clients on all aspects of portfolio management and working proactively to help clients achieve their business objectives. Nineteen years’ trademark experience and a demonstrable track record in advising businesses enables her to add value in many ways, ensuring robust protection and strategy around clients’ IP assets and optimising commercial returns on portfolios. With extensive experience across the wider retail sector, Ms Arch also heads up Barker Brettell’s specialist food and drink group.

Ms Arch practises in all areas of day-to-day trademark work, including advising clients on the adoption of new marks, the prosecution of applications in the United Kingdom, the European Union and overseas and on potential conflict matters. She also has significant experience in more strategic work, such as coordinating IP audits and reviewing and advising on the management of trademark portfolios, handling due-diligence projects, advising clients on clearance, undertaking re-branding and restructuring activities, policing and enforcing clients’ rights and negotiating agreements or settlements. Ms Arch has significant success in handling matters before the UK Trademarks Registry, the European Union Intellectual Property Office (EUIPO) and the World Intellectual Property Organisation, and over the past few years has been actively and successfully involved in a number of shape and trade dress matters.

Ms Arch joined Barker Brettell in 1997, qualified in 2001 and made partner in 2003. She is a member of the Chartered Institute of Trademark Attorneys, an EUIPO representative and a frequent participant in overseas conferences. Ms Arch studied in Liverpool and obtained an LLB (honours) with a concentration in commercial and IP matters before completing a diploma in legal practice at the College of Law, Chester and a postgraduate diploma in intellectual property at the University of London.
