Rob Litowitz

Partner at Kelly IP

Rob Litowitz is an outstanding strategist, persuasive writer and advocate who distils complex facts and issues into winning themes and narratives. Mr Litowitz’s litigation experience includes cases before the courts and the TTAB, and also false advertising, unfair competition, design patent, copyright and trade secret cases. He has worked extensively with leading experts to develop and present consumer surveys. Most recently, Mr Litowitz served as lead counsel in successfully defending a global lighting brand in a trademark case in which the plaintiff sought billions of dollars in damages. Mr Litowitz and Kelly IP defeated the damages claims on summary judgment, and then prevailed on the merits after a five-day trial. Currently, Mr Litowitz leads a team of Kelly IP lawyers who represent Tiger Woods’s golf course design company TGR DESIGN in an opposition at the TTAB. Mr Litowitz also recently served as lead counsel for plaintiffs at successful mediations in two federal trademark infringement lawsuits. Mr Litowitz has also litigated patent cases on products ranging from blockbuster prescription drugs to state-of-the-art jet engines. At both trial and appellate level, Mr Litowitz has secured wins for household brands and lifesaving medicines.

He has been recognised locally and internationally as a leading IP litigator and trademark practitioner. Mr Litowitz has received the following recognitions:

  • Silver status for enforcement and litigation in the Washington DC area by WTR 1000 (2016-2018);
  • IP Star by Managing Intellectual Property (2014-2018);
  • a recommended trademark lawyer by Legal 500 (2014-2017);
  • among the top legal practitioners in trademark law in the United States by Legal Media Group's Expert Guides: Guide to the World's Leading Trademark Lawyers (2014, 2016 and 2018); and
  • one of the Best IP Lawyers (2011-2013) by Washingtonian magazine.

He recently served as a member of INTA’s committee on famous marks. Before joining Kelly IP, Mr Litowitz practised IP law for 26 years at Finnegan, Henderson, Farabow, Garrett & Dunner, LLP in Washington DC, where he was a partner for 20 years and served on the firm’s management and compensation committees.
