Hank Spuhler is a shareholder at McAndrews, Held & Malloy and has a broad base of experience counselling clients in all aspects of IP law across a wide array of businesses and technologies. He currently manages trademark portfolios for numerous clients, consisting of thousands of cases in the United States and over 120 foreign countries. He also has significant experience in enforcing trademark rights before the Trademark Trial and Appeal Board and in district court. He also has experience in registering and enforcing trademark rights with Customs and Border Protection.

Mr Spuhler is also well versed in domain name issues, having filed and prosecuted several domain name disputes before the Internet Corporation for Assigned Names and Numbers (ICANN) under the Uniform Domain Name Dispute Resolution Policy and registered numerous trademarks with ICANN in connection with the release of new gTLDs.

Mr Spuhler has also assisted clients in licensing and monetising their intellectual property, including representation in multiple corporate/asset acquisitions collectively valued at over $3.5 billion. Examples include representing Sears (and its successor) in connection with the sale of its Craftsman tool ($900 million) and DieHard battery ($200 million) businesses.

Mr Spuhler has also appeared in dozens of patent infringement cases in district court and before the Federal Circuit and International Trade Commission, and has counselled clients on practice before the Patent Trial and Appeal Board. His experience spans a wide array of products and technologies, including cellular and satellite technology, wireless networking systems, GPS products, medical devices and sporting equipment. He also has extensive experience in litigation relating to reasonable and non-discriminatory terms involving cellular, Wi-Fi, Bluetooth and DSL standards. Of note, Mr Spuhler was part of a team that obtained an $891 million settlement on behalf of a client in the semiconductor industry, and played a lead role in a recent patent case before former senior judge James Holderman of the Northern District of Illinois, which the court characterised as “one of the best-presented cases I have had in my career” and “an exercise in excellence from a litigation standpoint”.
