Edward Maluf

IP Practice Group Co-Chair at Seyfarth Shaw LLP

Edward Maluf is the co-chair of the firm’s national IP practice group and co-lead of the firm’s false advertising and product labelling and warnings practice group. Mr Maluf is an IP litigator, prosecutor and counsellor. He assists clients with a diverse array of engagements including obtaining, enforcing and defending their IP rights. This also includes transactional representation where clients are in need of advice in connection with acquisitions of portfolios and other valuable intangible assets, maintenance of valuable existing IP portfolios, and licensing.

Mr Maluf has nearly three decades of experience representing domestic and foreign clients. His IP experience started early in his career, and includes matters that deal with quickly changing and developing technologies. One such case from the 1990s, as the internet was becoming ubiquitous, resulted in a landmark decision that recast the ‘hot news’ misappropriation doctrine and its status under federal copyright preemption.

Throughout his career, Mr Maluf has represented emerging and mature companies, content creators and owners, and holders of internationally recognised brands. These include financial services firms, food services companies, alcoholic and non-alcoholic beverage companies, vitamin supplement manufacturers and retailers, apparel companies, luxury goods manufacturers, publishers, consumer electronics firms, mobile communications carriers, and others.

Clients seek his counsel in connection with all areas of domestic and international trademark, copyright, counterfeit and grey market goods, and unfair competition issues. Mr Maluf also represents clients in false advertising litigation in federal court and before the National Advertising Division and the National Advertising Review Board. He also counsels clients in connection with their proposed marketing programmes.

Although always a New Yorker, Mr Maluf has lived abroad in Spanish and German-speaking countries. He is a first-generation US son of Dominican parents. He grew up speaking Spanish as his native language, and became conversant in German while a college student.
