Chanille Carswell has 20 years of litigation experience, including 11 years of TTAB and federal court trademark litigation. She is the co-chair of Brooks Kushman’s litigation practice group, and focuses her practice on enforcement, including managing foreign and domestic opposition/cancellation proceedings and federal court litigation. Ms Carswell’s experience includes all aspects of trademark, trade dress, copyright and patent litigation from the inception of a case through trial, including motion practice, discovery, depositions and settlement negotiations, as well as unfair competition, and appeals in a wide range of industries such as automotive, banking, construction machinery, consumer products, e-commerce and insurance.

Ms Carswell has litigated cases across the country and has extensive experience in briefing and/or arguing motions for dismissal, summary judgment, discovery, Daubert exclusion, preliminary and permanent injunctions, contempt and sanctions. Her experience also includes trademark counselling, clearance, protection and enforcement, and the management of the domestic and foreign trademark portfolios of Fortune 500 companies.

Prior to joining Brooks Kushman, Ms Carswell served as a judicial law clerk for the Honourable Victoria A Roberts of the US District Court for the Eastern District of Michigan. There she researched and drafted bench memoranda, orders and opinions in various practice areas including trademark, trade dress and patent infringement, product liability and commercial law.
