The Cancellation Division of the EUIPO has dismissed a request for the revocation of the mark TRUMP, finding that the owner had proven genuine use for all the contested services in Class 43.
The Cancellation Division of the EUIPO has dismissed a request for the revocation of the mark TRUMP, finding that the owner had proven genuine use for all the contested services in Class 43.
The General Court annulled the decision of the EUIPO Board of Appeal in these opposition proceedings, reiterating that the evidence of genuine use must be assessed as a whole.
The trademark community has just one week left to nominate its leading in-house departments and leaders for the prestigious WTR Industry Awards 2024 and the forthcoming edition of the WTR 300.
The decision demonstrates the limitations of trademark law in addressing competitive behaviour.
