Metatags come to the ECJ

In Belgian Electronic Sorting Technology BV v Peelaers, the ECJ has considered the interpretation of the term ‘advertising’ under Article 2 of Directive 84/450/EEC and Article 2 of Directive 2006/114/EC on misleading and comparative advertising. BEST alleged that the registration and use of the domain name ‘’ and the use of certain metadata infringed its trademark and trade name, and infringed the law on misleading and comparative advertising.

'.pw' to be relaunched as the 'professional web' extension

‘.pw’, the ccTLD for Palau, an island nation that forms part of Micronesia, is soon to be relaunched. When ‘.pw’ was first launched in 2004, it was marketed as short for ‘personal web’. This time, ‘.pw’ will be marketed differently in an attempt to attract a larger public. During the sunrise period, holders of any trademark registered before December 1 2012 will be able to apply for ‘.pw’ domain names that are an exact or close match to their mark.

The removal followed enquiries from World Trademark Review about the motivation for using trademark terms and highlights the challenge facing those marketing gTLDs to brands.

Etsy expands on Redskins ban as pressure over team name grows

Over the past week pressure to change the Washington Redskins’ team name has grown, with the threat of legislation to end the National Football League’s tax-exempt status if it does not act. Online marketplace Etsy has also announced that it will no longer permit the sale of products bearing the team’s name or logo. While some have questioned the policy, a spokesperson for the site has expanded on the site’s approach to takedown and marketplace policing.
