Counterfeit buyers increasingly using Chinese agents that promote sending fakes through “sensitive shipping lines”

Evidence suggests that purchasers of counterfeit goods are increasingly using buying agents in China to send their products to them internationally. Worryingly, some of these agents are proactively promoting their ability to get replica products through customs – with one promising that they will be sent via “sensitive shipping lines”.

PRET A MANGER held to be highly distinctive

The General Court has upheld the decision to reject an application for the mark PRET A DINER following opposition by Pret A Manger. The court found that the appeal lacked substantive arguments and the decision demonstrates that a high degree of distinctiveness and reputation will satisfy assessment purposes where there is a low degree of similarity between marks.

In Re DLMW-BBQ LLC the Trademark Trial and Appeal Board has held in a non-precedential decision that the mark BLACK BARK for restaurant services was entitled to registration and reversed the examining attorney’s refusal based on the prior registration of BLACK BARK BRISKET for “meat; prepared meat”.

IKEA’s widespread trademark use in Indonesia is not enough use

A recent Supreme Court decision cancelling some of IKEA’s trademarks on the grounds of non-use means that any three-year period of non-use potentially makes trademarks vulnerable and subsequent use does not rectify this. A harsh judgment, perhaps, but one which is within the interpretation of the law.

Majority of suspected online infringers re-register popular domain names, according to new study

A new report from the EU Intellectual Property Office has revealed that the phenomenon of e-shops marketing infringing goods via previously used brand-related domain names – as observed in Denmark – is also occurring in Sweden, Germany, the United Kingdom and Spain. Worryingly, the study claims that it is occurring to a higher degree than expected.
