Vietnam partners with Japan to launch e-filing system

Vietnam's national trademark registry has launched an online filing system in cooperation with the Japan International Cooperation Agency.

Hanoi Anti-counterfeit and Trademark Protection Association launched

Prompted by rampant counterfeiting and a number of recent cases that resulted in death or serious illness, the Hanoi Anti-counterfeit and Trademark Protection Association has been launched to nationwide press coverage. The organization's activities aim to protect both consumers and trademark owners.

New guidelines on civil IP rights disputes

The People's Supreme Court, the People's Supreme Procuracy, the Ministry of Culture, Sport and Tourism, the Ministry of Science and Technology, and the Ministry of Justice have adopted a new inter-ministerial circular, which provides guidance on civil IP rights disputes. The new circular aims to harmonize the application of the law by the people's courts.

New guidelines on criminal actions for infringement of IP rights

The People's Supreme Court, the People's Supreme Procuracy, the Ministry of Police and the Ministry of Justice have adopted an inter-ministerial circular which aims to provide guidelines on criminal actions in IP rights infringement cases. The new circular entered into force on April 2 2008.

Draft circular on industrial property assessments issued

The Ministry of Science and Technology has issued a draft circular which provides guidelines for industrial property assessments. Among other things, an entity has the right to conduct an industrial property assessment where at least two of its members possess an IP assessor card and it has been issued with the relevant certificate by the National Office of Intellectual Property or the ministry.

KINGMAX owner loses its crown

The National Office of Intellectual Property has cancelled the trademark KINGMAX for goods in Class 9 of the Nice Classification. The office found that Vien Son Company, the owner of the mark, was not entitled to apply for the registration of KINGMAX at the time of filing under Articles 14(2)(a) and (c) of Governmental Decree 63/CP.

ABBA application meets its Waterloo on appeal

The Ministry of Science and Technology of Vietnam has rejected an application to register the figurative mark ABBA for goods in Class 16 of the Nice Classification. The ministry found that the mark would confuse the public as to the origin of the goods to which it would apply, even though Swedish band ABBA cannot be considered a 'foreign organization' under Vietnamese law.

Guidelines for People's Court in trademark matters to be revealed

The Supreme People's Court, the Supreme People's Procuracy and the Ministry of Science and Technology are drafting a joint circular providing guidelines to the People's Court on the application of certain provisions of the Law on Intellectual Property. The aim is to ensure appropriate and harmonized application of the law by the People's Court.

New circular for industrial property guidelines drafted

The Ministry of Science and Technology has drafted a circular that provides guidelines for the implementation of the new IP law and Decree 103/2006/ND-CP on industrial property. Among other things, the circular provides guidelines on procedures for (i) establishing industrial property rights, and (ii) registering contracts for the transfer of industrial property rights.

New decree on handling IP administrative violations in force

Decree 106/2006/ND-CP on handling administrative violations in the field of industrial property came into force on October 21 2006. The decree, which was published on October 6 2006, provides guidelines on, among other things, what constitutes an administrative violation, the form and level of penalties applicable and the types of procedures to be employed.
