HUGO BOSS not a notorious mark, rules minister of trade

In <i>Hugo Boss AG v Citadino Internacional CA</i>, the Venezuelan minister of trade has rejected Hugo Boss's opposition to the registration of the mark BOSS DE CITADINO. The minister held that Hugo Boss had failed to demonstrate that its HUGO BOSS mark was notorious in Venezuela.

Bacardi's mark not famous enough to block competitor's registration

The Venezuelan Ministry of Production and Commerce has rejected Bacardi's opposition to the registration of 'Hatuey' as a mark for beers. The ministry found that Bacardi's submissions to prove that its own HATUEY mark, which is not registered in Venezuela, is well known - and thus warrants protection - did not meet the registrar's evidence standard.

CORN FLAKES is generic but valid, says PTO

In <i>Maizoro SA de CV v Kellogg Company</i>, the Venezuelan Patent and Trademark Office has rejected the claim that the registration of the CORN FLAKES mark is invalid. It found that although the mark had become generic through use, it was not generic when the registration was granted.

New exchange controls affect trademark licences

The Exchange Administration Commission has stated that local companies that must acquire foreign exchange to comply with their licence obligations should provide proof that their licence agreements have been duly registered. This announcement was made in response to the government's new exchange controls prohibiting the sale of foreign currency.
