YouTube obtains cancellation of 'youtube.gr'

The National Telecommunications and Post Committee, the authority responsible for the supervision of the administration of domain names in Greece, has ordered the cancellation of the domain name 'youtube.gr'. Among other things, the committee recognized that the YOUTUBE mark was famous and notorious in Greece.

No similarity between ISIC and ISIS, says court

The Athens Administrative Court of First Instance has reversed a Trademark Committee decision that partially rejected the application to extend protection to Greece of the international registration for the trademark ISIC on the grounds that it was confusingly similar to the registered trademark ISIS. Among other things, the court held that there was no visual or phonetic similarity between the marks.

No confusion between HONDA LOGO and LOGO trademarks

The Athens Administrative Court of Appeals has affirmed the dismissal of the opposition by the Greek owner of the mark LOGO against the application filed by Japanese company Honda Kigen Kogyo Kabushiki Kaisha for the registration of the trademark HONDA LOGO. The court found that the dominant part of the mark HONDA LOGO was the name Honda, which in itself was sufficiently distinctive.

'expedia.gr' registration checks out

The National Telecommunications and Post Committee, the authority responsible for supervising the administration of domain names in Greece, has ordered the cancellation of the domain name 'expedia.gr', which was initially registered in the name of a Greek company. The committee held that the domain name had been registered in bad faith as it exploited unfairly the rights of online travel agent Expedia Inc.

SNOOPY mark application for fast food services rejected

An Athens court has rejected a trademark application filed by a Greek company for SNOOPY FAST FOOD and a device featuring the well-known Snoopy character. Among other things, the court held that consumers were likely to believe that a restaurant operating under the mark SNOOPY FAST FOOD and the Snoopy device was endorsed by the owner of copyright and trademark rights in the Snoopy character - United Features Syndicate.

FIFA scores with 'fifa.gr' cancellation action

The National Telecommunications and Post Committee, the authority responsible for supervising the administration of domain names in Greece, has ordered the cancellation of the domain name 'fifa.gr', which was initially registered in the name of an individual. The committee held that the domain name had been registered and used in bad faith as it exploited unfairly the Fédération Internationale de Football Association's trademarks.

Prior ELCO registration leads to partial cancellation

The Cancellation Division of the Office for Harmonization in the Internal Market has upheld a partial invalidity action filed by the Greek company ELCO VAGIONIS AE against a Community trademark registration for ELCO on the basis of the Greek company's prior registered national ELCO mark.

Olympos not a misleading geographical indication

The Administrative Trademark Committee has dismissed four cancellation petitions filed against four trademarks, each containing the name Olympos (the Greek for mount Olympus). A majority of the committee held that the name Olympos was not a misleading geographical indication.

Newspaper mark remains famous despite 12 years of non-use

The Administrative Trademark Committee has rejected an application for cancellation of the mark MESIMVRINI (ΜΕΣΗΜΒΡΙΝΗ in Greek), which refers to the name of a Greek newspaper that ceased publishing around 12 years ago. The committee held that despite the fact that the newspaper has not been in circulation for a number of years, it has retained its trademark rights.

CHOCO TWISTERS and TWIST not confusing

The Athens Administrative Court of First Instance has dismissed Kraft Foods' opposition to an application to register the mark CHOCO TWISTERS in relation to chocolate. The court found, among other things, that Kraft's TWIST trademark for the same products created an overall visual and phonetic impression that was different from that created by CHOCO TWISTERS.
