João Luís Garcia is a partner of Simões, Garcia, Corte-Real & Associados with 25 years’ experience in intellectual property. He is an official industrial property agent, a European trademark and design attorney, a European patent attorney, a lawyer, an arbitrator and a member of several international IP associations.

After 12 years working in another Portuguese IP firm, he joined Simões, Garcia, Corte-Real & Associados in 2001.

Over his career, he has had extensive experience in IP prosecution and enforcement in different jurisdictions, including Portugal and African countries such as Angola, St Thomas and Prince, Mozambique and Cape Verde.

He advises on matters relating to IP rights protection abroad and the coordination of rights transfers across different countries. He has represented trademark owners in several cases relating to seizures by Customs.

One of his main areas of activity is litigation – namely, court actions for IP rights infringement. He has recently participated as an arbitrator in several disputes between pharmaceutical patent owners and generic companies.

Mr Garcia is experienced in domestic and international arbitration (institutional or ad hoc) – particularly in disputes relating to pharmaceutical patents and generic drugs. Moreover, he has intervened in a number of arbitration cases dealing with domain names.

Mr Garcia often works on commercial and contentious IP matters with IP specialists in many European and non-European countries and in several Portuguese-speaking jurisdictions. In particular, he advises on unfair competition, copyright and domain names, as well as on trademark and design oppositions before national offices and the EU Intellectual Property Office (EUIPO). He has represented major rights holders before national offices, the EUIPO and the courts.

Mr Garcia has authored several articles and spoken at conferences on IP issues.

He is a member of the following associations:
