Gold - Individuals: enforcement and litigation

Tucker Ellis impresses with its comprehensive contentious/non-contentious trademark protection skillset, but is best known for its authority in the area of online brand enforcement. Both experts in this regard, David Steele and Howard Kroll come in for considerable praise from those who know them best. “David thinks outside the box and is exceptionally creative; he’s pragmatic, too, and keeps budgets in mind without sacrificing quality. His insight on cyber issues is highly beneficial and the quality of his service is great – he is responsive on all matters, large and small, and his billing practices are very fair.” In a cybersquatting and trademark infringement and dilution case of first impression, he is currently representing Facebook, Instagram and WhatsApp in seeking to impose liability on an ICANN registrar and its privacy company for failure to disclose the identity of its cybersquatting customers. Also involved in this matter, Kroll “protects his clients in a smart, positive and energetic way, while facilitating business rather than being a barrier to it”.

Firm Profile

At Tucker Ellis, we understand that our clients want counsel who inspire trust and confidence and take their best interests to heart. Our culture of excellence, service, teamwork, diversity and loyalty to our clients, communities and one another is what sets us apart and drives us each day as we aspire to vastly improve the manner in which legal services are provided.

Founded by 65 lawyers in 2003, Tucker Ellis LLP has strategically grown to more than 215 lawyers serving clients nationwide from six locations: Chicago, Cleveland, Columbus, Los Angeles, San Francisco and St Louis.

We are proud to serve a Fortune 250 list of national litigation clients, a national and international IP clientele and sophisticated business clients. Our firm is structured to build and maintain the strongest and deepest internal and external relationships, foster true teamwork with our clients and one another, and continuously work to improve every facet of what we do.

Having no billable hour requirement means that we reward our lawyers for their accomplishments rather than the number of hours they bill, giving us more freedom to work under either traditional or flexible fee arrangements, train and mentor our lawyers and staff, and focus on getting work done. Similarly, because we do not track origination or source credit for our lawyers, we are uniquely able to collaborate fully and collegially to benefit our clients.

Our IP group

Tucker Ellis views intellectual property in terms of the value and competitive advantage it brings to our clients. At Tucker Ellis, our clients find everything they need: a full-service national IP practice composed of a cohesive group of professionals who are experienced and acclaimed across the globe in handling:

  • trials and litigation;
  • IP strategy to maximise value and protection;
  • patent and trademark procurement;
  • internet and domain name law;
  • technology transfer;
  • analysis of IP issues (clearance, opinions, freedom to operate); and
  • brand protection counselling and enforcement.

We take a different and better approach to creating, managing and enforcing intellectual property. By taking the time to look at each client individually, regardless of the size of the matter, we provide personalised service and develop programmes to suit different and diverse needs. We take an innovative and fresh approach to each matter to benefit our clients in terms of both quality and value.

The Tucker Ellis IP Group is best known for providing superior legal analysis with extraordinary client service in all areas of intellectual property (consulting, litigation, and/or prosecution) for clients of all sizes. Our group has continued to ascend in ranking and recognition by competing against larger and older firms in requests for proposal and winning those engagements. We are honoured to provide superior and comprehensive service to clients ranging from small start-ups and solo inventors to mid-sized companies and Fortune 250 corporations.

Building relationships with our clients

Our practice is devoted to building relationships with our clients and understanding their business and needs so that we can provide a tailored IP legal experience. These relationships help us to better understand our clients’ businesses to develop innovative, customised strategies to meet their needs. These sound relationships have become key as the value of intellectual property has grown over the past decade. Our continuing exceptional growth is a testament to our philosophy of building relationships and getting to know every aspect of every client’s business.
