Bronze - Individuals: prosecution and strategy
Whenever clients are in need, SCAN Avocats is always on the other end of the phone, ready and able to provide effective, streamlined advice at a moment’s notice. From four offices in Paris, Lyon, Strasbourg and Bordeaux, it dispenses astute advice not only on trademark matters, but also in related fields such as copyright, data privacy, domain names and e-commerce. Whatever the problem, the team’s forward-thinking approach and wealth of technical expertise ensure it gets solved in a jiffy. One client which has lately entrusted the firm with its portfolio and enforcement programme is railway operator SNCF, which receives a sterling service from Sandra Cabanne. The trademarks, designs and advertising boffin comes recommended by clients for her “expertise, knowledge, availability, responsiveness and accuracy”. “She is extremely rigorous with great attention to detail, makes robust recommendations and offers innovative, well-argued solutions. She handles complex matters efficiently and always considers the wider commercial context.” Her equal is Alexandre Nappey, an authority on all things Internet who reacts with precision and keen commercial sense. “Alexandre has extensive expertise in domain name issues, providing excellent legal guidance in this field.”
Alexandre Nappey co-founded SCAN AVOCATS in October 2017 with Sandra Cabanne, bringing with them the team (associates and paralegal) they had been working with at a Paris IP boutique. The firm is based in Paris and has branches in Strasbourg and Lyon. Four years after its creation, SCAN AVOCATS employs nine lawyers and two paralegals.
Mr Nappey began his career in 1999 as a European trademark attorney for a major IP law firm, where he set up and developed the IT law department. After becoming a lawyer in 2012, he joined Europe’s largest law firm as a senior manager in intellectual property and information technology, before joining a Paris IP boutique as a partner in August 2015 and founding SCAN AVOCATS two years later.
Mr Nappey has developed a recognised expertise in IP litigation and prosecution (trademarks, designs, copyright and anti-counterfeiting), as well as IT law (domain names, internet, e-commerce and software, data privacy and e-reputation), contracts (IP transfer, licensing and coexistence agreements), unfair competition law, distribution and comparative advertising.
Mr Nappey counsels, assists and represents large and medium-sized domestic and foreign companies, but also start-ups and public bodies, in a broad range of industries – including luxury goods, media, real estate, pharma and retail, and innovative start-ups – before the EUIPO, WIPO, national trademark offices and civil courts.
Mr Nappey has been an accredited WIPO and Czech Arbitration Court panellist since 2006, and was invited by WIPO and the French Network Information Centre to be an expert for the French PARL EXPERT in 2016.
He teaches IT law at the Centre for International Intellectual Property Studies, the European Institute for Enterprise and Intellectual Property, the Bar School and Strasbourg University.
Mr Nappey regularly speaks at international conferences on intellectual property and information technology, and writes for legal publications.
He has featured in The Legal 500 and Decideurs since 2015 and in WTR 1000 since 2016, where he is described as “an internet-focused whizz with the talent to make clients of all shapes and sizes feel that they are his only concern”. “Alexandre Nappey has these qualities (ie, a combination of technical knowledge, commercial sense and pragmatism) in abundance.” He is ranked in the Leading Individuals Strategy and Prosecution categories.
Founded by Sandra Cabanne and Alexandre Nappey on 1 October 2017, SCAN Avocats is a specialist IP and IT law firm based in Paris. The firm (nine lawyers and two paralegals) has offices in Lyon, Strasbourg and Bordeaux.
SCAN Avocats helps clients to protect their IP assets on a worldwide basis, thanks to its extensive network of correspondents.
The firm represents large and medium-sized domestic and foreign clients in a broad range of industries – including transport, insurance and pensions, retirement homes, agri-food, luxury items and jewellery, media, coding, real estate and retail, as well as innovative start-ups – before the National Industrial Property Institute, the EUIPO, national trademark offices, French civil, commercial and criminal courts and arbitration courts.
SCAN Avocats’ lawyers are well known for their legal advice and representation in:
- IP law;
- prosecution and litigation (including trademarks, designs and models, domain names, authors’ rights, copyright and anti-counterfeiting);
- IT and digital law;
- and data privacy law.
The team offers a modern approach to these areas of law and understands the clients’ needs. It is quick to respond, thanks to a combination of readily available technical knowledge and pragmatism.
The partners also run IP and IT law sessions with training institutes and universities (notably the Centre for International Intellectual Property Studies, the European Institute for Enterprise and Intellectual Property, the Bar school and Strasbourg University) and are lecturers for the National Industrial Property Institute Master Class programme.
SCAN Avocats develops strategies and creative solutions and provides bespoke legal advice to its clients, enabling them to rise to their business challenges. The team uses state-of-the-art technology to work efficiently with clients. This technology includes collaboration tools, budget monitoring, an IP rights’ database and reporting.
Both founding partners have recognised expertise in litigation and the prosecution of traditional intellectual property, as well as new technologies, including domain names, software, data privacy and e-reputation. Contracts, unfair competition law, distribution and comparative advertising are also key features of their practice.
Ms Cabanne began her legal career in 2002 as a criminal law attorney. In order to broaden her experience of practical business, she joined the French national railways (SNCF) legal department and was made head of the IP department of the SNCF Voyages division. In 2009 Ms Cabanne decided to move back to a law firm as an IP senior associate and in 2011 she joined an IP and IT boutique firm in Paris, where she became partner in March 2013.
She has been recognised by Décideurs Leader’s League since 2013, by the Legal 500 since 2013 and by the WTR 1000 since 2016. The WTR 1000 2019 specified that: “Sandra Cabanne has these qualities (ie, a combination of technical knowledge, commercial sense and pragmatism) in abundance”. In the 2020 edition, she was described as follows: “Cabanne can be called on to advise on all manner of IP disputes and contractual issues.” She is recognised in the fields of enforcement and litigation, as well as in prosecution and strategy.
