Gold - Firms

One of the US IP market’s major developments occurred in June 2021, when Crowell & Moring and Chicago IP royalty Brinks Gilson & Lione announced their combination. The move presents exciting opportunities for the legacy Brinks Chicago team given the new firm’s interdisciplinary approach to legal problem solving and its ability, as a general practice, to handle trademark and brand issues in their wider context; Crowell & Moring also has international offices (Brussels, Doha, London and Shanghai) and a broader US footprint that present additional advantages. It’s a brand-new day, then, for Howard Michael, Andrew Avsec, Virginia Wolk Marino, Jeffery Handelman and David Fleming, although much remains unchanged, including their commitment to IP excellence. Michael and Avsec also remain in a leadership positions, the former now serving as co-chair of the firm’s technology and brand practice group and the latter as co-head of the technology litigation, trademark and copyright practice. Both garner enthusiastic reviews: “Howard is an experienced litigator and a deep strategic thinker who is ultra-focused on getting the best outcomes in the most efficient way possible.” “Andrew is an engaging and highly intelligent, lateral-thinking lawyer who thoroughly understands his clients’ trademark concerns.” Marino also attracts praise: “She’s a go-to in the US for anything trademark related and an absolute pleasure to work with. She gives sound advice that gets right to the heart of the legal issue while keeping the business side of things in mind.” ‘Global brand protector’ best describes the role she plays. Handelman brings the heat in litigation on behalf of famous brands and is as authoritative as anyone regarding TTAB practice. The most experienced of the lot, Fleming has honed his IP skills over four decades and is looked up to by all in the global trademark community.

Bronze - Firms: enforcement and litigation

The big news at Crowell & Moring is its recent integration of Chicago boutique Brinks Gilson & Lione in a move that took its IP practice up 10 levels. The quality of the firm’s existing IP, technology, brand protection and digital transformation team matches well with that of its newcomers’, creating a synergistic group capable of achieving great things. The combination will doubtlessly bring new opportunities to Kent Goss and Valerie Goo, who do a sterling job anchoring Crowell & Moring’s trademark practice on the West Coast; both are highly experienced litigators who are recognised as “top-notch” by illustrious advocates at competitor firms. They are well suited to complex cases in which trademark and other branches of law intersect and are also frequently called in at short notice when matters look like they are heading to trial. In such circumstances, they are currently defending MillerCoors in a suit filed by Stone Brewing involving claims of trademark infringement, trademark dilution and unfair competition arising from the packaging refresh of MillerCoors’ Keystone brand beer.

Silver - Firms

Highly regarded for its expertise in the patent sphere, Crowell & Moring also showcases a deft touch across the branding spectrum. The IP group has a particular affinity for complex issues around non-traditional marks and has also recently invested in cutting-edge technology to superb effect. Department co-head Jan-Diederik Lindemans exemplifies the set’s practical approach and combines deep legal know-how with a strategic view of clients’ commercial objectives. He has lately been advising Delta Light on its IP portfolio and assisting the lighting manufacturer with enforcement matters. Kristof Roox is an authority in the pharmaceutical space who is representing Novartis in a number of parallel import disputes involving several of its blockbuster products.
