The IP scene in Spain has been thriving recently and the country’s practitioners continue to discuss the favourable changes brought by the EU Trademark Directive, which was implemented into national law in 2019. Since then, the news that cancellation actions will be filed with the Spanish Patent and Trademark office from 2023 onwards, rather than going to the courts, has gained a lot of attention. Local attorneys are curious to see how this turns out.
