The Slovenian trademark community continues to mull over the revised IP Act which came into force in March 2020, transposing the EU Trademark Directive into national law. Practitioners are still familiarising themselves with the new regime – with momentum somewhat slowed as a result of the covid-19 pandemic – but are largely enthusiastic about the opportunities it presents. That said, there is a push for greater clarity on the new non-use defence – which was previously limited to cancellation actions – in opposition and infringement proceedings.
