As would be expected of one of the most innovative countries in the world, Finland continues to be a favourable jurisdiction for rights holders and its IP scene is as vibrant as ever. Practitioners report peak levels of activity on the non-contentious front, with filing instructions flooding in from companies large and small. This indicates high levels of awareness of the importance of securing proper IP protection from the very outset; but it seems as though EU applications are increasingly favoured over national filings. From a legislative standpoint, as of 1 May 2021, the Trade Name Act has been amended to allow for the full or partial revocation of a trade name through an administrative process at the Finnish Patent and Registration Office. This is particularly beneficial as Finnish trade names can prevent the registration of not only other trade names, but also trademarks. The key requirements for successful revocation are that the trade name in question not have been used for the past five years and its proprietor have no justifiable reason for non-use. Meanwhile, counterfeiting activity has been on the rise in the last 12 to 24 months across Europe generally and brand owners are reminded to stay vigilant – particularly when it comes to online marketplaces.
