Registration of colour trademarks permitted

The Industrial Property Office of Iran has adopted a new procedure for the registration of colour trademarks. Both single and multicolour trademarks may now be registered. Colour trademark applications are examined with regards to distinctiveness and non-functionality.

Applicants must clearly state the colours for which protection is sought. The filing need not include the relevant colour definition standards; a mere description of the colours will suffice. The office has classified colour marks according to the International Classification of the Figurative Elements of Marks.

Since the Trademark Gazette does not publish marks in colour, the colours for which protection has been obtained are only named in the publication, but coloured samples of the marks will be available at the Industrial Property Office for public reference.
