Combating counterfeiting in Canada requires use of the following legislation: • the Trademarks Act (RSC 1985, c T-13); • the Copyright Act (RSC 1985, c C-42); and • the Criminal Code (RSC 1985, c C-46). Only the Copyright Act contains both civil and criminal offence and penalty provisions, and provisions prohibiting the import of infringing merchandise (Sections 27 and 42).
