Combating counterfeiting in Canada requires use of the following legislation: the Trademarks Act (RSC 1985, c T-13), the Copyright Act (RSC 1985, c C-42) and the Criminal Code (RSC 1985, c C-46). Only the Copyright Act contains both civil and criminal offence and penalty provisions, as well as provisions prohibiting the import of infringing merchandise (Sections 27 and 42).
