Israel

Israel’s customs authorities have clearly stepped up their game in the last few years, with practitioners continuing to report border officials’ improved understanding of how to conduct seizures. This is especially useful given that the country is increasingly attractive to importers (especially parallel importers, given recent legal developments), as well as to international rights holders (including Amazon). Another topic causing waves is cannabis: although Israel has not formally legalised the substance, there is a rapidly growing international export market and dizzying profits to be made for innovative Israeli companies with strong IP rights. Observers should expect trademark rights to become an even more hotly contested space in the coming years.

Adin Liss Pyernik IP Group

Full-service IP boutique Adin Liss Pyernik is as strong at the drafting desk as it is in the courtroom. The firm’s unique selling point is the fact that its attorneys are often familiar with both sides of the practice – which leads to watertight trademark applications and outstandingly informed litigation arguments. Two versatile practitioners, Dan Adin and Eran Liss, are among the cream of the crop in Israel. “Their professionalism is as deep as their legal knowledge. They marshal facts and prepare arguments very well and have a strong presence in the courtroom, which persuades judges effectively. They also take an individual approach to each case.” “They are to be found at the cutting-edge of IP knowledge in Israel – both are highly professional, well-experienced and service-oriented.”

Dr Eyal Bressler & Co

Dr Eyal Bressler & Co is a sterling choice for non-contentious trademark matters that require the kind of steady hand that results from decades of experience. The innovators and IP attorneys based at the firm have seen most conceivable trademark scenarios, so are ideally placed to tackle any intractable prosecution and transactional issues that might arise. Technology transfer and acquisitions sage Neil Wilkof is one of Israel’s finest. “He is a true scholar, a guru and master of trademark licensing. An academic at heart, he is very good at considering the wider ramifications of trademark strategy.”

Dr Shlomo Cohen & Co

Shlomo Cohen is a veteran of the Israeli IP scene. Experienced and talented across both sides of the contentious/non-contentious divide, his depth of knowledge, connections and sheer name recognition are legendary. His eponymous practice is well-networked internationally, broad in its technical range and experienced beyond most others: in other words, an ambitious patron’s dream partner.

Drori-Werzansky-Orland, Advocates and Patent Attorneys

Drori-Werzansky-Orland is an established national leader in IP theory and its application. The firm applies a meticulous level of scrutiny to every brief and portfolio – which, along with its emphasised dedication to building strong client relationships, has helped to keep it at the top of the tree in Israel. Twin founders Yonatan Drori and Yotam Werzansky Orland continue to drive and shape the practice. Drori brings top-level internet-based litigation capabilities to the table, while head of litigation Werzansky Orland adds his acute appreciation for licensing and commercialisation to the mix. Both partners are prolific publishers who stay abreast of every trademark development, as well as seasoned lawyers with an eye for the strongest arguments.

Ehrlich Group

The Ehrlich Group covers patrons from every conceivable angle, providing a complete launchpad, safety net and shield for rights holders who are well-informed enough to enlist its support. Its sparkling roster includes huge names in global sport, as well as worldwide leaders such as Dell, Polo-Ralph Lauren and Tommee Tippee. So dedicated is the firm to the success of its clients that it sometimes loses money in pursuing the best course of action – and a deep interest in every individual business situation comes as standard. Enforcement ace Yehuda Neubauer is a superb trademark advocate. “His advice is prompt, expedite and useful. He perfectly understands clients’ needs and provides practical, detailed, well-founded recommendations. The experience of working with him is simply outstanding.”

Ellen B Shankman & Associates

When the who’s who of global technology companies come to Israel, they all tend to call in at the same destination first. One-woman army Ellen Shankman has been prosecuting, strategising and monetising trademarks for decades now. The internet specialist’s particular brand of holistic, culturally coherent and commercially oriented counsel translates into every language, making her one of the top names in Israel for this type of work. “Ellen is a true thought leader in trademark law, an innovative thinker who always has business-oriented solutions to offer. She is efficient and thoughtful – a killer combination. She is a supernova.”

Gilat, Bareket & Co, Reinhold Cohn Group

The Reinhold Cohn Group is an irresistible force, a “well-oiled machine” and the IP practice in Israel by which all others must measure themselves. The firm has reached the very top of the pyramid, as demonstrated by the quality and importance of the mandates and portfolios it tackles on an everyday basis. Clients – including adidas, Calvin Klein, Warner Bros, Pernod Picard and Under Armour – rely on it for litigation, prosecution and transactional work. A particular highlight this year has been a complex trademark enforcement case for furniture retailer Habitat International, which went all the way to Israel’s Supreme Court. Litigators Luiz Blanc and Rakefet Peled were instrumental in the victory. “Globally minded veteran” Blanc is “an excellent advisor who is internationally recognised as an expert in complex trademark matters”. “His level of service, commitment and communication is very impressive. Intelligent and thorough, he always considers the clients’ best interests and produces the highest quality of work.” Peled is “a pragmatic, target-oriented practitioner with very strong pleading skills”. “Her contributions are always spot-on, her advice being clear, understandable and related to the case.” David Gilat and Eran Bareket give their names to the firm’s contentious division, Gilat Bareket Attorneys at Law. Gilat is “reliable, responsive, business-minded, creative and has a wealth of experience”, while Bareket heads the firm’s legal practice, steering the team superbly. Head of enforcement Roy Kornick is especially effective when working on mandates in the sports and automotive industries. “Timely in his responses and always available, Roy is also creative and has something to add strategically. He truly becomes a part of any in-house team he works with.” Certified mediator Orit Gonen always knows when to settle and when to push; she is a strategic master. As head of the trademarks practice, Ronit Barzik-Soffer is a key cog in the firm’s machine. “She is excellent – very experienced, and an expert both in trademark clearance and prosecution.”

Herzog Fox & Neeman

“Israel’s number one firm for commercial law” Herzog Fox & Neeman is composed of a team of “uniquely excellent, go-to experts whose knowledge of branding and client care exceeds all expectations”. “It stands out above all other Israeli firms because it can do more than just trademarks, having an excellent reputation for licensing and technology transfer work in a multinational context in particular.” Karen Leslie Elburg is a truly first-rate trademark practitioner, and one of the world’s foremost experts in online gaming law to boot. “Her advice is proactive, reflecting on all aspects of every discussion. She is an experienced lawyer with a bright mind, attentive to detail and sophisticated.” Jenia Melkhior is a dab hand with commercial agreements of all shapes and sizes; this year, she has been busy ironing out a domain name matter on behalf of client Virtual Assets IP Ltd, amongst other work. Adar Bengom “always considers the situation both in Israel and abroad, ensuring fruitful discussions every time”. “Modest, kind and friendly, she is the next-generation name in the game.”

Liad Whatstein & Co

For anti-counterfeiting, litigation, strategic and sophisticated prosecution mandates, ambitious rights holders need look no further than Liad Whatstein & Co. Patrons seeking “strong expertise, straight-to-the-point advice and practicality” have come to the right place and will be joining a list of names that already includes Merck, Louis Vuitton, Viacom and FIFA. “Brilliant” Israeli IP litigator and rainmaker-in-chief Liad Whatstein is “very dedicated indeed to his practice – he doesn’t ever seem to sleep”. “Attentive, well-prepared, extremely fast and competent, he is able to swiftly understand clients’ top priorities.”

Lipa Meir & Co Advocates

Full-service Israeli titan Lipa Meir & Co boasts an IP practice good enough not only to satisfy the firm’s demanding clients, but to attract new devotees as well. Operating across a broad range of technical sectors including wine (on behalf of Carmel Winery), healthcare (Clalit Health Services) and hotels (Astral Hotels), the firm is both large in scale and personal – a difficult balance to achieve, but one that is paying dividends in the form of long-lasting client relationships. The “patient and thorough” Gali Opinsky is equally at home in the courtroom and the boardroom. “Smart, responsive, knowledgeable and – most importantly – quick, she is deeply professional. She is a really excellent attorney.” Transactional partner Gary Copelovitz heads up the firm’s international department. His greatest strength is the breadth of his practice; his ability to work across most areas of commercial law and never lose sight of crucial detail is truly impressive.

Meitar Liquornik Geva Leshem Tal Law Offices

As Israel’s largest full-service international law firm, Meitar Liquornik Geva Leshem Tal may already have achieved national dominance but it shows no sign of slowing down its rapid expansion. Callers from New York or London could be forgiven for thinking that they have dialled an internal extension by accident, such is the practice’s cosmopolitan feel. Described by one top competitor as “the Slaughter and May of Israel”, the firm is home to many attorneys who have trained internationally and innately understand the global business context in which many of their clients operate. Yoav Oestreicher spearheads the redoubtable trademark litigation arm. “A brilliant and pragmatic attorney, he is one of the top IP litigators in the country. He has excellent judgement, a robust sense of humour, and truly understands the needs of US companies.” Head of the technology group David Mirchin is the name to note for all non-contentious queries. “Savvy and a great communicator, he is a wonderful attorney who has built a strong team. Strong business sense, legal expertise and responsiveness await those who come to either him or the firm in general.”

Pearl Cohen Zedek Latzer Baratz

Multinational IP dynamo Pearl Cohen Zedek Latzer Baratz makes every client feel as though they are the firm’s only concern. “On a personal level, Pearl Cohen is a pleasure to work with. Everyone there is helpful, professional and available for consultation at all hours and on all matters, small and large. One never feels – as is sometimes the case in large firms – that you are falling between the cracks; the opposite is true there. From the most senior partner down to the junior lawyers, you get the sense that everyone is personally responsible for you – and will hand you off smoothly and seamlessly to another lawyer, if they feel that your matter falls better within someone else’s field of expertise.” Superlative client care is, of course, the flipside of the firm’s “business-oriented, strategic and detail-oriented” counsel in contentious and non-contentious trademark mandates alike. “The honesty you find at the firm is totally remarkable; it is professional to the highest level and a rare find indeed in the legal sector.” Tel Aviv-based portfolio management wizard and “authentic leader” Dor Cohen Zedek is “very well-networked indeed”. One of the most influential women in the entire IP world, she acts for clients of the calibre of Levi Strauss, Swatch Group and Microsoft. Thoroughbred litigator Yossi Markovich is able to pursue infringers with equal zeal in court and at the border. “A guiding force towards a client’s long-term best interests, he understands when it’s time to settle and time to fight. He is one of the leading IP and trademark experts in Israel – creative, practical and solution-oriented, he is an open-minded and swift thinker.”

Price Plinner Law Offices

Agile and honest, boutique Price Plinner is adept at navigating all fields of IP practice on behalf of its stable of adoring clients; litigation, contractual support and prosecution all fall under the firm’s wide umbrella. Rather like his firm, name partner Eyal Price is a true IP all-rounder. “A great guy and a very competent lawyer, he is very honest. Reasonable and knowledgeable, he approaches cases in a good spirit. Eyal is an excellent litigator with the ability to plead superbly.”

S Friedman & Co

S Friedman & Co is “a renowned law firm with expertise, knowledge, experience and a client-oriented approach”. The “high degree of care and professionalism” that the team applies to every trademark litigation, prosecution and transactional mandate it encounters translates into a superb service for the stable of universities, start-ups and traditional companies which it serves. As one client says: “nowadays, in an environment with so much stressful change, it is a pleasure to work with a team that is responsive and keeps the essence of human relationships”. The “excellent” Gavriel Disegni is “clear and comprehensive” in his counsel. He leads the firm’s IP practice, and boasts special expertise in the application of IP law in academic settings. The transactional side of the firm has two outstanding practitioners. Head of the high-tech group Tal Tirosh excels at managing complex international transactions, especially in the technology and life sciences spaces. Oren Sharon sees co-ventures from both sides of the table; an entrepreneur himself, he is innately commercial and has a thorough understanding of business risk.

S Horowitz & Co

Full-service titan S Horowitz & Co has a “preeminent reputation” in Israel for litigation and strategic advice in the patent and trademark fields. “The firm is second to none – superb, and well above its competitors in terms of service, quality and professionalism. The team’s expertise, creativity, ability to think outside the box and tight command of deadlines sets it apart.” Venerated IP litigator Tal Band heads the practice. His sheer gravitas and ability to execute in the courtroom have made him an indispensable part of the strategy of global giants including Teva and Anheuser-Busch; he is “one of the nation’s finest”. Avi Ordo is, quite simply, the first trademark practitioner in the country to spring to mind for many of his peers. “A forceful litigator with an unparalleled level of experience in significant cases, he is a superb, stand-alone lawyer and a true professional.” “Avi’s cross-examination skills are nothing short of brilliant. He sees the big picture but, simultaneously, pays attention to detail. His knowledge of trademark law extends well beyond the boundaries of Israel – he clearly leads the pack.” Like Ordo, partner Moran Katz appears on three different WTR1000 2020 individual tables. A broad expert with a specific talent for regulatory matters, she is “always available, knowledgeable, devoted and experienced – a fast thinker and a great litigator”. “Sharp-minded and creative, she also has a strong commercial sense.” Dovev Apel is a safe pair of hands for the highest-pressure disputes; among his stable of clients sits Lego, a company that trusts him with registration, strategy and customs seizures.

Seligsohn Gabrieli & Co

Multidisciplinary IP boutique Seligsohn Gabrieli & Co is a “small firm of high integrity”; an outfit where the two leading partners take a sincere interest in every case and know their clients inside out. Clients, including fashion houses Gucci and Giorgio Armani, healthcare solutions provider Medtronic and jeweller Pandora, flock to enforcement aces Nahum Gabrieli and Ehud Gabrieli for considered advice. “They are the leading experts in trademarks and designs; dedicated and always available, their reactivity and high-quality analysis of complex trademark issues make them very recommendable.” Head of department Nahum is an “excellent litigator” whose presence and judgement anchors the practice. Ehud is an anti-counterfeiting expert who knows how to get things done at the border. “Very smart, he has a great sense of humour to boot.”

Yaacov Salomon, Lipschutz & Co

Broad commercial partnership Yaacov Salomon, Lipschutz & Co nurtures an IP commercialisation offering that many describe as one of the jewels in its crown. “The team has exceptional expertise in trademark law and excellent communication skills. Knowledgeable and practical, it always handles work efficiently.” Smooth advocate Narda ben Zvi is involved in some truly high-level briefs, including a complex, cross-border trademark battle on behalf of Brooks Sport against Speedo Holdings. “Efficient in trademark registration and a craftsman of litigation strategy, she can dominate a courtroom and always provides a tailored solution to legal problems.” “Narda is a sharp, knowledgeable and creative counsel and a licensing whizz. She is masterful in litigation: wise and aggressive, she knows exactly when to attack and when to compromise. A genuinely decent colleague with integrity.”
