Benelux: Netherlands

One of the most watched trademark cases in Europe in recent times has been the battle between Christian Louboutin and Dutch company vanHaren; the latter was accused of infringing Louboutin’s trademarks by selling a range of red-soled shoes. The European Court of Justice ruled in favour of Louboutin, noting that the shoemaker was not seeking to protect a combination of a colour and a shape – which the court had indicated could be refused trademark protection – but the application of a colour to a specific part of the shoe. Changes to the Benelux Convention on Intellectual Property have been another focus; where previously appeals from the Benelux Office of Intellectual Property could be lodged at the Court of Appeal of The Hague, these must now be filed with the Benelux Court of Justice – a rule change designed to make decision making more consistent across Benelux.
