Obafemi Agaba is a partner and head of the brand protection and anti-counterfeiting practice at Jackson, Etti & Edu.

He obtained an LLB from the Lagos State University in 1998 and was called to the Nigerian Bar in 2000. He holds a postgraduate diploma in UK, EU and US copyright law from King’s College London, and has also completed an LLM in IP law at the University College London.

In his role as head of the firm’s brand protection practice, Mr Agaba has successfully represented several local and multinational clients in various trademark, copyright and patent cases. He is an expert in obtaining ex parte Anton Piller search and seizure orders and encouraging infringers to seek amicable resolution. He constantly advises on, designs and executes specialised enforcement and anti-counterfeiting campaigns to meet the individual needs of the firm’s clients in various industry sectors. These include civil and criminal court actions, regulatory enforcement and raid actions (with Customs, the police, the Standards Organisation of Nigeria, the Consumer Protection Council and the National Agency for Food and Drug Administration and Control, among others) as well as market surveys, investigations and public enlightenment. One of his landmark anti-counterfeiting campaigns was a multi-pronged campaign designed and executed for a global energy company, which led to the seizures of counterfeit goods worth approximately $2 million, and the revocation of trademark certificates that had been obtained by the party surreptitiously.

Mr Agaba is also a leading light in media and entertainment practice. He advises on the origination, production, financing, marketing and distribution of creative works, and formulates and executes tailor-made strategies for the protection and enforcement of the resulting IP rights. He also has ample experience in imparting knowledge and facilitating training programmes relating to the entertainment sector in Nigeria.

Mr Agaba was recently appointed as a key member of the committee reviewing the Industrial Property Commission Bill, which has the primary aim of turning the trademarks and patent registry into an independent, self-funding and accountable office.
