Bart A Lazar is a strategic problem solver with more than three decades of experience in counselling clients in trademark creation, clearance, commercialisation and disputes, data privacy and security, copyright, advertising, promotion, right of publicity and related matters.

He acts as lead and local counsel in trademark, trade dress, anti-counterfeiting, false advertising, unfair competition, copyright, computer fraud and abuse, and internet-related litigation, and has investigated and obtained creative remedies to combat piracy, cybercrime and other internet mischiefs. He has obtained numerous ex parte temporary restraining and seizure orders in trademark counterfeiting, software piracy and cybercrime matters, as well as assisted in criminal prosecutions for hacking, phishing, extortion, trademark counterfeiting, and felony theft/kickbacks.

Mr Lazar has extensive experience in crafting and negotiating trademark and copyright licences, as well as strategic alliances and joint marketing arrangements designed to commercialise P rights.

Mr Lazar works with clients to execute innovative promotional programmes, including spokesperson, influencer and ambassador programmes, pop-up or other experiential marketing, market research and other social media and traditional media promotional programmes, advertising and sweepstakes. He has litigated advertising matters in federal court and before the National Advertising Division.

Mr Lazar helps clients structure and implement strategies to comply with global data privacy, security and related laws, and has crafted and negotiated data analytics protection and data licensing agreements, notices and terms of use relevant to the processing of personal and aggregated or pseudonymized data. He has investigated and responded to hundreds of incidents involving the security of consumer, employee, social media and health-related data.

Mr Lazar has handled numerous privacy matters before federal and state agencies, including defending the first internet privacy case brought by the Federal Trade Commission and the first database security breach case brought by the New York Attorney General.

Mr Lazar is an adjunct professor at Illinois Institute of Technology/Chicago-Kent College of Law, teaching trademarks and unfair competition and IP student externships.
