Barry Fong practises IP law with an emphasis on trademarks, domain names, anti-counterfeiting enforcement and copyright.

He is a registered trademark agent and regularly advises domestic and foreign clients on trademark clearance, prosecution, opposition, acquisition, licensing and litigation. He acts on behalf of the owners of some of the most recognised Canadian and international brands across a broad range of industries, including fashion, hospitality, media and entertainment, wine and spirits, pharmaceuticals and professional sports.

In his copyright practice, Mr Fong regularly acts on behalf of parties engaged in contract negotiations, administrative proceedings and litigation involving complex issues of copyright law, including the educational use of copyright-protected works, artists’ exhibition and reproduction rights, the provision of professional services in the visual arts and the use of music for public performances. He has appeared before the Copyright Board of Canada in numerous tariff proceedings, as well as before the Federal Court and Federal Court of Appeal. He also completed a secondment as associate counsel to Re:Sound, a Canadian not-for-profit music licensing company that represents thousands of artists and record companies for their performance rights.

Mr Fong co-authored the chapter on copyright in Intellectual Property Disputes: Resolutions and Remedies, a reference for litigators and counsel advising on IP disputes, edited by Ronald E Dimock and published by Thomson Reuters Canada. He is an active member of various committees of industry associations, including the International Trademark Association and the Intellectual Property Institute of Canada. He has spoken on both trademark and copyright-related issues at numerous conferences and seminars.
