Taft’s team of IP attorneys focuses on providing comprehensive legal strategies to support clients’ needs and goals. Our group consists of more than 60 attorneys, including over 35 registered patent attorneys whose experience and connections put them in an ideal position to protect our clients’ IP needs.
In addition to patent, trademark and copyright protection and litigation, our IP attorneys advise clients on trade secret protection, unfair competition, false advertising and the right of publicity. We have experience representing clients across industries, including financial services, software development, electric manufacturing, specialty chemicals, security, automotive, entertainment and healthcare.
Our attorneys assist clients in a range of traditional and innovative IP matters, from drafting licensing and development agreements and handling disputes, to assisting individuals and institutions from early research through commercialisation.
Taft’s IP attorneys are experienced in handling IP rights issues in website development, hosting, co-branding and online content licence agreements. We provide advisory services to internet start-up businesses, as well as many established companies of all sizes based in the Midwest and throughout the United States.
Trademark searching and prosecution of applications for trademark registration are traditional elements of our practice. As a preliminary step to a full availability search, we are able to assist our clients through online screening searches. For this service, we subscribe to SAEGIS, as well as the databases available through LexisNexis and Westlaw. Thus, clients typically have turned to our attorneys for assistance in formulating new trademarks even before seeking clearance approval or opinion letters.
The maintenance of our clients’ existing trademark registrations, including the filing of Sections 8 and 15 affidavits and renewals, is facilitated through the use of a computerised trademark database system. Not only is the system automated to alert attorneys of approaching filing dates, it also has been designed to merge database records with form documents and letters to provide the most efficient services possible.
For clients with a large number of registrations to maintain, such a system is invaluable. Our practice handles international trademark matters for many of our clients. We assist clients in determining a strategy for globalisation of their brand and related business.
On occasion, we work with foreign counsel already employed for other matters by our clients. We engage or recommend local foreign counsel with whom we have worked previously and who have demonstrated competence, reliability, accessibility and attention to our clients’ needs.
In addition to trademark and copyright issues, our attorneys advise clients on trade secret protection, unfair competition and false advertising. We have experience drafting and negotiating licences, development agreements, non-disclosure and other agreements for use with research institutions, employees, independent contractors and other business partners of all types.
Taft also has a robust ‘soft’ IP litigation practice with considerable depth. Our team litigates trademark, copyright and other non-patent/unfair competition cases around the country. Our IP litigation experience includes:

- opposition and cancellation proceedings before the Trademark Trial and Appeal Board;

Taft’s IP group has grown considerably over the past five years, along with the firm. In January 2020 Taft will merge with Minneapolis-based Briggs and Morgan adding 135 lawyers to the firm, including 15 IP attorneys, and additional offices in Minneapolis, St Paul and Denver.
