Dinsmore & Shohl LLP

Increasing numbers of Fortune 50 companies trust Dinsmore’s growing trademark practice with the management of their global trademark portfolios. With over 50,000 trademarks managed in 190 countries, Dinsmore leverages its deep bench of diverse legal professionals to strategically protect, manage and enforce domestic and global trademarks. Dinsmore’s trademark team has extensive experience in all aspects of trademark management, from initial clearance and strategy to prosecution of applications worldwide, to enforcement and portfolio management, to licensing and advertising review. The sizeable practice, with 68 attorneys, paralegals and staff, is run by accomplished attorneys known for their strong commitment to creating business-focused partnerships with clients. The team views success through the lens of its clients and its advice is grounded in a comprehensive understanding of the complexities of the IP rights at issue. Throughout each of its client relationships, Dinsmore’s trademark team strives to live up to its commitment to innovation, continuous improvement and digital transformation. Dinsmore is continuously growing and improving its offering and regularly collaborates with clients to innovate new approaches. The team actively resists ‘pushing paper’ or acting as a ‘post box law firm’ that simply forwards correspondence from trademark offices around the globe. It prefers to define itself by an ability to provide innovative, strategic, cost-effective, business-smart advice and counsel with experienced client teams that reflect Dinsmore’s commitment to diversity and inclusion.

Scope of services

Dinsmore’s trademark team provides counselling, enforcement and defence of claims involving trademarks, copyright, advertising, domain names and unfair competition, and other forms of non-patent intellectual property. The team is experienced across a wide range of specialised industries, including consumer products, technology, luxury goods, retail services, digital media, manufacturing, financial services and healthcare. It is also adept in its ability to deal with the challenges of developing industries such as the craft beer and cannabis industries. The team has substantial experience in successfully prosecuting and defending enforcement matters across the country and internationally, whether in federal or state court or before the Trademark Trial and Appeal Board. It also routinely handles Internet Corporation for Assigned Names and Numbers (and associated country-code disputes) proceedings regarding domain names.

A global client base looks to Dinsmore to deliver sophisticated and tailored domestic and international trademark portfolio management, extensive clearance searches, marketing and advertising review, litigation, enforcement and defence, Uniform Domain Name Dispute Resolution Policy and social media enforcement, and general counselling and advice on related trademark and branding issues. Beyond these more traditional trademark services, the teams also offer additional tailored services to meet the needs and objectives of each client, including customised trademark portfolio audits, assistance with transactions and due diligence, and onsite custom continuing legal education to in-house legal teams or focused training sessions for client business team members.

Commitment to diversity

Dinsmore’s trademark team is not only accomplished, but also diverse with over 60% of the practice made up of diverse and/or women attorneys. A singular focus on diversity and inclusion in each of the teams proposed for client work has resulted in Dinsmore’s trademark practice far exceeding national averages. The IP department overall is a prime example of the firm’s commitment to diversity and inclusion. With nearly 100 IP attorneys at the firm, almost half of our team identifies as female, racially diverse, LGBTQ or as a veteran.
