An interesting decision has come out of the General Court with regard to the registrability of three dimensional trademarks in Europe, with the importance of the word element of the packaging being de-emphasized. With cases involving trademarks for packaging shapes few and far between, the decision is important as it helps mark owners to assess the extent of the protection available to them.
