Well-known mark protection in China, Hong Kong, Macau and Taiwan

Since June 2003 China has granted well-known status to 69 marks – an encouraging sign to mark owners that they
can protect their rights in one of the world’s largest and fastest
growing consumer markets. Chi Keung Kwong of Sit Fung Kwong & Shum reports
that, although adequate legislation is in place, certain issues remain to be
resolved, in particular the criteria to consider when granting
a mark well-known status. He finds that this is also true of Hong Kong, Macau
and Taiwan - territories linked to China by their history, culture and language.
