Walmart’s opposition to supermarket slogan dismissed
On May 31 2011 the Russian Patent Disputes Chamber dismissed Walmart’s opposition against an application by Maria-Ra, one of the largest supermarket chains in Russia, to register its slogan.
Walmart, a US public multinational corporation that runs chains of large discount department stores and warehouse stores, filed an opposition against Maria-Ra’s application for the registration of the slogan “Pay less. Live better” in Russian.
Walmart claimed that it was similar to its slogan “Save money. Live better”.
The Patent Disputes Chamber ruled that the literal translation of Walmart’s 'Save money' in Russian is 'Keep money' or 'economise money'. Therefore, “Save money” could not be translated as “Pay less”, and there was no violation of Walmart's mark by the defendant. The chamber added that the two marks were not confusingly similar because the design elements were different. Walmart’s opposition was thus dismissed.
