Vitasoy left out in the cold with ICY trademark

Vitasoy International Holdings Limited has failed to register the word ‘icy’ as a trademark in Australia following objections by The Coca-Cola Company. The registrar held that neither the word ‘icy’ nor the get up of the trademark rendered it inherently distinctive or capable of distinguishing the goods. The application for registration was therefore rejected.
