On September 17 2008 the Venezuelan Patent and Trademark Office (SAPI) decided that the relevant trademark and patent legislation would be the IndustrialProperty Law 1956. This has caused ambiguity regarding the applicable legislation, since the Constitutional Chamber of the Supreme Court of Justice has not excluded the application of the Andean Community legislation, which was incorporated into Venezuela’s legal system inaccordance with the 1999 Constitution.
