TTAB proceeding and settlement discussions about trademark use are insufficient bases for declaratory judgment jurisdiction

A US district court has held that the filing of an action before the Trademark Trial and Appeal Board, without more, does not create a “case or controversy” to establish subject-matter jurisdiction under the Declaratory Judgment Act.
