Trademark classifications amended to mirror Nice accord
A new Chilean decree (285/2003) has come into force which, among other things, implements the Eighth Edition of the Nice Classification into Chilean law. Specifically, three new classes (43, 44 and 45) have been added and the scope of another class (42) has been reduced. In addition, many services have been relocated to the new classes.
The new class headings in Chile, mirroring the Nice Classification, are as follows:
- Class 42 - Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software; legal services.
- Class 43 - Services for providing food and drink; temporary accommodation.
- Class 44 - Medical services; veterinary services; hygienic and beauty care for human beings or animals; agriculture, horticulture and forestry services.
- Class 45 - Personal and social services rendered by others to meet the needs of individuals; security services for the protection of property and individuals.
Each of these classes is applicable to new and pending applications. Trademark applicants whose petitions are pending are required to amend their applications and pay any additional registration fees as a result of adding new classes. In addition, the new classes will be applicable to trademark registrations that are renewed in future.
