There’s no sugarcoating it: Pocky’s cookie design trade dress is functional
The US Court of Appeals for the Third Circuit has held for the second time that the product configuration of the Pocky – a chocolate-dipped, stick-shaped cookie – was functional and thus not subject to trade dress protection.
