The battle of the Earnhardts

Teresa Earnhardt recently filed an appeal against Kerry Earnhardt, Inc (KEI) after the Trademark Trial and Appeal Board (TTAB) dismissed an opposition against the US trademark application for EARNHARDT COLLECTION. The court found that the TTAB's analysis was deficient and therefore reversed its decision that EARNHARDT COLLECTION was not merely a surname.
