Supreme Court upgrades rules on trademark prosecution

The Supreme People’s Court has released the “Provisions on Certain Issues Related to Trials of Administrative Cases Involving the Granting and Confirmation of Trademark Rights”, which come into effect as of March 1 2017. The provisions address challenging trademark issues, including bad-faith registrations, the adjudication standards for well-known trademarks and the scope of protectable prior rights.
