The Trademark Trial and Appeal Board (TTAB ) recently upheld an examiner’s refusal to register a stylised version of the NORDIC mark, despite a consent agreement between the parties. The TTAB held that the Icelandic letters used in the applicant’s mark did not create distinctive design elements and therefore, the mark was not inherently distinctive.
