South Africa

In South Africa, trademarks are governed by the Trademarks Act (194/1993) and its regulations, as well as judicial precedent. Although the act deals with all aspects ofregistered trademarks, it is not the only legal instrument in South Africa to recognise and enforce trademark rights. The Companies Act, the Consumer Protection Act and theCounterfeit Goods Act all acknowledge registered trademarks.
