The EU General Court has held that the EU Intellectual Property Office Board of Appeal had correctly found a likelihood of confusion between word mark SO…? and the figurative mark ‘SO'BiO ētic’ with regard to the goods which were identical or similar under Regulation 207/2009, and thus a “risk of tarnishment”.
