A district court recently decided that Primo Broodstock was entitled to a preliminary injunction on the basis of its Lanham Act claim. The court held that there was a substantial likelihood of success at trial based on the claims that the defendants had disseminated false commercial statements and used the plaintiff’s Primo name without permission.
