The Montenegro Intellectual Property Office has announced that it no longer accepts copies of Serbian trademark filings or validity certificates in order to obtain a certificate of registration in Montenegro.
Serbian national rights registered before May 28 2008 - the date on which the office was officially inaugurated - have been automatically recognized in Montenegro. However, in order to receive a Montenegrin certificate of registration, the owner must request its issuance formally (for further details please see "Montenegro Intellectual Property Office to open").
Until June 17 2008, a copy of the trademark filing or validity certificate was sufficient in order to obtain a certificate of registration in Montenegro pursuant to the Montenegrin Decree on the Enforcement of Intellectual Property Rights. However, the original or a certified copy of the Serbian filing or validity certificate is now required.
The deadline for filing the original or a certified copy is 30 days from the filing of the request for a certificate of registration.
Most importantly, IP rights holders that have already submitted copies of the Serbian filing or validity certificate must now re-submit the original or a certified copy of the filing or validity certificate within one month of the notification of this change of practice (ie, by July 17 2008).
