The Trademark Trial and Appeal Board recently considered whether a mark that potentially falls within the scope of Section 2(e)(3) of the federal Lanham Act must be examined in its entirety, or alternatively whether a geographic place name incorporated in the mark can in and of itself lead to a finding of unregistrability.
