Operator of a physical market is intermediary

The European Court of Justice has held that the operator of a physical market was an intermediary in the sense of Article 11 of Directive 2004/48/EC, and that it was therefore possible to issue an injunction against the intermediary even though it was not responsible for the IP infringement.
