No protection for EXHAUST-GARD

In Deere & Company v EU Intellectual Property Office (EUIPO) the EU General Court has confirmed a decision of the EUIPO Fourth Board of Appeal which had denied protection for the word mark EXHAUST-GARD for “diesel exhaust fluid” in Class 1. The board of appeal held that the mark was descriptive and devoid of distinctive character.
