New Law on Industrial Property enters into force

The new Macedonian Law on Industrial Property entered into force on February 25 2009.
Among other things, the law allows interested parties to initiate administrative proceedings against decisions of the Macedonian Office of Industrial Property before the Administrative Court of Macedonia. The proceedings must be filed within 30 days of the issuance of the decision.
Under the new law, third parties are now able to oppose applications for the registration of published trademarks on absolute grounds.
Moreover, the new law provides that patent applicants are required to state their choice of examination procedure no later than six months after the filing of the application.
Another new feature concerns the payment of patent annuities: under the new law, it is no longer necessary to obtain a power of attorney for this purpose.
