The General Court has affirmed a decision of the First Board of Appeal of the European Union Intellectual Property Office, revoking a European trademark on the ground that the evidence provided by its proprietor was not capable of establishing genuine use of that the mark. The court also refused to consider new evidence filed on appeal.
