National classification system revised following entry into force of 11th edition of Nice Classification


The latest (11th) edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification) entered into force on January 1 2017, and brought significant additions and amendments to the previous edition.

The Turkish Patent and Trademark Office revised Turkey’s classification of goods/services for trademark application purposes in compliance with the latest edition of the Nice Classification, and the revised classification has also been in force since January 1.

This update seems to require certain trademark owners - especially those in the cosmetics and beauty, textile and personal accessories industries - to register and/or monitor their trademarks in different classes in order to ensure their proper protection.

In particular, Classes 3, 5, 10, 11, 35, 42 and 45 have been modified. The main changes to Turkey’s national classification system are as follows:

  • Cosmetics and soaps for medical purposes have been added to Class 5, while cosmetics and soaps in Class 3 have been limited to those not including medicine.
  • Wearable electronics (eg, smart watches and smart bracelets) have been added to Class 10, bracelets and rings for medical purposes (bracelets and rings for the prevention of rheumatism) have been added to Class 11, while watches, bracelets and rings have been listed under Class 14.
  • Electric heated socks have been added to Class 11, while socks have been listed under Class 25.
  • Electronic cigarettes and their refills have been added to Class 34.
  • Design services for advertising purposes have been added to Class 35, while "design services other than engineering, computer and architectural design; graphic arts designing" in Class 42 have been limited to those not for the purpose of advertising and landscaping.
  • The services of "providing sellers and consumers with online marketing websites" have been added to Class 35.
  • "Social network creating services" have been added to Class 45.
